I implemented this on www.skinningtoolkit.com.  The method I used was to create two new pages, one named privacy and the other named terms. I then created links to these pages directly within my skin and removed the [PRIVACY] and [TERMS] tokens from my skin.

(in the page settings I set the pages to hidden)

Currently in DotNetNuke this is the only method I know of to implement this.  The advantage you have now is that you can select a different skin for the privacy and terms, as well as the SEO advantage in that the search engines will not index the privacy and terms pages as duplicate content, they will now just index them as one single page.

Thank you for the solution. Is it possible to make those two pages look like how "Privacy Statement" looks? Also, if I set the page to hidden, it says only admins can view the page. Am I missing something?

Yes, just apply the same skin to the new page - go to Page Settings

In Page Settings you need to make sure that view permissions are set to all users not just admininstrators
