This is a method I use. The reason I use this method is because search engines index the Terms of use and privacy as a new page for every single page where the links are displayed because of how DNN creates the links to the terms and privacy pages.
This could mean that the search engines see this content as duplicate content and give you penalties for it. - I haven't seen it happen yet, but it is a possibility.

Add the content to this page and use the skin that you require
Create a new page, set to hidden, name it Privacy
Add content
In your skins, instead of using the Terms and Privacy tokens, just create a link directly to the pages that you have just created: ie.
<a href="http://www.skinningtoolkit.com/tabid/191/Default.aspx">Terms of Use</a>
